These Terms and Conditions (“BillPay Terms” or “Terms”) govern the bill payment services provided by INDmoney Tech Private Limited (Formerly known as Finzoom Investment Advisors Private Limited) ("Company", "we", "our", or "us") a company incorporated under the Companies Act 2013, with its registered office at 616, 6 th Floor, Suncity Success Tower, Golf Course Extension Road, Sector - 65, Gurugram, Haryana-122005, India, which offers its services product through its website and mobile application (“INDmoney Platform” or “Platform”) under the name and style of INDmoney (“INDmoney”).

Through the INDmoney Platform, we facilitate the payments of bills for various services, including but not limited to electricity, piped gas, recharges, credit card bill pay and other utilities through the BBPOU duly covered under NBBL's BBPS framework (“BillPay Services” or “Services”).

By registering on INDmoney Platform, you ("User", "you", or "your") agree to these BillPay Terms in addition to the General Terms and Conditions, to enable INDmoney Platform to facilitate you in offering BillPay Services. In the event of a conflict between the BillPay Terms and the General Terms and Conditions, these BillPay Terms will prevail for the Services. You also consent to all relevant Company policies, including our Privacy Policy, available on the INDmoney Platform.

DEFINITIONS
1. “Agent Institution” shall mean an agent onboarded by BBPOU (defined below) as a user service point for provision of Bill Payment Services (defined below). Company is facilitating the Bill Payment Services in the capacity of an Agent Institution after being duly onboarded by a duly authorised BBPOU.
2. “BBPCU” shall mean Bharat Bill Payment Central Unit i.e., NBBL - a single authorized entity operating BBPS (defined below).
3. "BBPS” shall mean Bharat Bill Payment System Services under the supervision of NBBL/ RBI.
4. “BBPOU” shall mean Bharat Bill Payment Operating Unit operating under the applicable Bharat Bill Payment System regulatory framework.
5. “Biller” shall mean a service provider who ultimately receives payments from Users and participates in the BBPS through the BBPOU and shall be read with the meaning ascribed to the terms in the BBPS Procedural Guidelines (as amended from time to time).
6. "Bill" shall mean the amount a user pays to a Biller through an Agent Institution for Bill Payment, which may include service charges, convenience charges, taxes, and any other applicable costs.
7. “Bill Payment” shall mean the Bill paid by the User, wholly or in part for the utilities, credit card bills and/or other services provided by the Biller.
8. “Third Party Service Provider(s)” includes but not limited to payment gateways, payment service providers, SMS providers or other third parties from whom Company avails various services / facilities in relation to offering BillPay Services.
OUR ROLE
1. The Company is an Agent Institution onboarded by the BBPOU, an authorized Bharat Bill Payment Operating Unit registered with National Payments Corporation of India (“NPCI”) and RBI. You understand and acknowledge that our role is restricted to facilitating your payment instructions and providing other value-added services. The User acknowledges and agrees that the Company acts solely as a facilitator and is not a party to, nor has control over, any transactions between the User and any Biller or transactions related to any Bill. The Company is not involved in any arrangement between the User and the Biller and holds no payment obligation toward either party. We merely facilitate Bill Payment transactions, allowing you to make payments to the issued Bill by the Biller.
2. Without prejudice to anything contained in these Terms, the User agrees that the Company is:
  1. solely a facilitator of Services, i.e., facilitating payments between the User and the Biller for services availed from the Biller;
  2. not a party to the Services;
  3. not a payment system provider in relation to its role under these BillPay Terms;
  4. not responsible in any manner whatsoever for the processing and settlement of payments relating to the Services, since the Company is merely facilitating the Services;
  5. not responsible for any aspect of the Services;
  6. not a party to, and shall not be responsible for, any disputes, chargebacks, or reversals arising pursuant to the Services, since we are only facilitating the Services; and
  7. not a party to, and shall not be responsible for, any disputes, chargebacks, or reversals arising pursuant to the Services, since we are only facilitating the Services; and
3. The Company facilitates BillPay Services, allowing the User to make payments for various services including mobile postpaid and prepaid recharges, landline phone bills, DTH services, utility payments (e.g., electricity, LPG, water tax), internet broadband, toll tax recharges (FastTag), and other services that the Company may offer from time to time. These services are available under the "My Bills / B mnemonic" section of the INDmoney Platform.
4. Offers provided to you by Billers on the Platform are solely between you and the respective Biller. The Company holds no responsibility for the content, validity, or fulfilment of such offers.
ACCESS AND USAGE
1. You can access the BillPay Services through the My Bills/Bmnemonic section of the INDmoney Platform. To use the Services, you may need to provide necessary details, such as your registered mobile number, bill number, and/or other bill related information. We will fetch your payment and due details to facilitate timely bill payments. You acknowledge that the accuracy of the information you provide is crucial for fetching the correct bill and subscription amounts. You agree to ensure the correctness of all information provided by you and accept full responsibility for any inaccuracies.
2. By using the Services, you agree to:
  1. Provide true, accurate, complete and up-to-date information about yourself ("Registration Data"), your payment account ("Payment Data"), and your Biller/Service Provider ("Biller Data"); and
  2. Regularly update this data to keep it accurate and current.
3. You acknowledge that the Company bears no responsibility and shall incur no financial liability if it is unable to process any Bill payment due to:
  1. Incomplete, inaccurate, invalid, or delayed payment instructions issued by you;
  2. Insufficient funds or limits in your payment account to cover the payment;
  3. Funds in the payment account being under any encumbrance or charge;
  4. Refusal or delay by your bank or the National Clearing Centre to honor the payment instruction;
  5. The Biller/Service Provider not processing the payment;
  6. Circumstances beyond the Company's control (e.g., natural disasters, strikes, power or system failures, external interference).
4. The Company reserves the right to add or remove Billers or payment account types at its discretion. Payment account options may vary for each Biller based on the Billers specific needs, and additional fees may apply for certain payment methods. Payment terms may differ depending on whether you use a card or bank account. Payments to a Biller can be made either: (a) via an online debit/charge from a payment account, or (b) by scheduling an automated debit, subject to the facilities offered by the third-party payment service providers.
5. You acknowledge that any transaction, whether completed or attempted, will be governed by the policies of BBPCU, BBPOU, and the policies of Billers, along with the relevant guidelines and these Terms.
USER OBLIGATIONS
1. You authorize us to access, fetch, share, use, and store information related to your Bill or account with the Biller on an ongoing basis on your behalf to provide the Services. You agree that for providing the Services, your user identifier, location/state, and any other personal information may be shared with the Biller for tax, GST, or other compliance purposes. Additionally, you authorize the Company to communicate with the Biller, BBPOUS, third-party service providers, aggregators, and other relevant entities using your account information as necessary for processing the BillPay transaction.
2. The BillPay Services that you intend to avail for payment of bills (including credit card bill payments), recharges etc. You hereby represent and assure that, you have complete authority or are otherwise legally entitled to pay for the said bills (including usage of credit cards as applicable) and as such you assume full responsibility for all transactions conducted by you including payments proceeds by using these BillPay Services.
3. If you use the BillPay Services on behalf of a third party and provide bill payment Information, fetch bill details, or make payments on their behalf, including for mobile recharges/top-ups, it is your responsibility to ensure that you have the consent of such third party. You agree that you have all necessary rights and permissions to allow us to use third- party bill payment Information on an ongoing basis and access the bill details from the respective Biller, on behalf of the third party for the purpose of the Company providing BillPay Services.
4. It is clarified that a Bill related to a bill payment on the INDmoney Platform is issued by the Biller for an underlying service they offer. A recharge on the INDmoney Platform is made to avail of the service provided by the Biller or the telecom provider, and an Insurance Payment is made on the INDmoney Platform to pay the premium for your insurance policy.
5. By using the Services, you agree to be responsible and liable for the payment of a Bill issued by a Biller. You shall always be in compliance with applicable law including and not limited to any BBPS guidelines and to keep your account information accurate and up to date. The Company reserves the right to suspend, deactivate, or terminate your access to the Services in case you violate any laws, regulations, or terms governing the use of these services.
6. You acknowledge that it is your sole responsibility to provide accurate information, including but not limited to customer identification numbers, bill reference numbers, payment details, mobile numbers, and the amount to be paid or recharged. To complete a bill payment or recharge, you must provide the necessary identifiers, such as customer identity or subscription numbers, bill numbers, registered mobile or telephone numbers, to retrieve the relevant payment details, bill value, subscription plan, and outstanding amounts ("Bill Payment Information"). We do not assume any responsibility for the accuracy and completeness of the data displayed on the INDmoney Platform (including Bills and Bill Payment Information). We strongly encourage our Users to validate all Bills (including that of credit cards) before making any payments thereof. The Company is not obligated to verify the accuracy of the information provided by you and will not be held responsible for any errors. You are responsible for verifying your bill payment requests against statements or records from the Biller. If you are making payments on behalf of a third party, you confirm that you have obtained their consent, and any claims from the third party will be your sole responsibility.
7. Once a bill payment is made on the INDmoney Platform, it only absolves you of your responsibility or liability to pay to the Biller only once. A confirmation from us of a successful bill payment does not make the Company responsible or liable, in any manner, for any future bill payments. It is your responsibility to verify the status (success/failure) of each payment through your transaction history or notifications from us. After registering with a Biller/Service Provider on the INDmoney Platform, you may view your current and future bill details, eligible recharge plans, or statements as they become available. It is your duty to carefully review your bill details before making any payments. For any discrepancies, please contact your Biller/Service Provider.
8. You are solely responsible for scheduling your bill payments, and you acknowledge that the payment processing time may vary based on the Biller/Service Provider. We will process payments only upon receiving your instructions. The Company is not liable for any delays, reversals, or transaction failures.
9. By making a bill payment for a particular Bill on the INDmoney Platform, you accept these Terms and expressly authorize the Company to obtain and display your future Bills for subsequent durations.
10. While we aim to process and settle your bill payments promptly, there may be cases where the payment is not immediately reflected against the particular Bill or Biller. We shall follow the below timelines:
  1. Pending Transactions: Transactions for bill payments or recharges generally gets confirmed instantly. In certain instances, confirmation delays from Billers might occur. A pending status on your transaction indicates that we are awaiting confirmation from the Biller. If the transaction is still pending after 48 hours, please raise a ticket with us for further assistance.
  2. Successful Transactions: If Bill payment or recharge is not updated or services are not provided within 48 hours following a successful payment or recharge, please contact us to report the issue. We will address your complaint or grievance and strive to resolve it within 30 business days from the receipt of your complaint.
  3. Refunds: Any applicable refunds from transactions made on the INDmoney platform will be credited back to the source account.. Refunds are typically processed within 10 business days.
11. You recognize the significance of timely bill payments including credit card bill payments. It’s important to note that any delay in payments/settlement of your Bills such as credit cards, EMI’s or other like nature Bills including transaction processing delays, may result in additional charges imposed by the bank, such as late payment fees, interest, penalties and such other rights that bank may have under the agreement executed by you with the bank. Furthermore, such delays could be reported to credit bureaus, adversely affecting your credit score. The Users are advised to keep in mind the transaction settlement timelines, any and all claims, issues, charges or other coercive action taken by bank due to non- payment or delayed payment or delayed settlement of transactions shall be at the sole risk, cost and responsibility of the User alone. We shall not be held responsible, liable or accountable for any claims, proceedings, or actions initiated by bank due to non-payment or delayed payment or delayed settlement of transactions arising due to any reasons whatsoever.
12. To facilitate efficient tracking of your bills and enable you to make timely payments, you allow the Company to auto-track your bills using your registered mobile number and/or Gmail (subject to your explicit consent for Gmail Connect). This service is intended solely for your convenience, and the Company does not guarantee the accuracy, completeness, or correctness of the bill amounts displayed, which are provided on an “as is” and “as available” basis. You are strongly encouraged to verify the payable amount directly with your biller, and any queries regarding your bill should be addressed to them. The Company may, for your convenience, send you bill payment reminders via notifications or messages. However, the Company is not liable for any missed payments or service disruptions due to delays in bill fetching or notification delivery. You may choose to discontinue the auto-tracking of your bills at any time by accessing the settings of the applicable bill under the "My Bills" section of the INDmoney Platform.
13. You also agree that the Company may set up reminder facility or auto payment facility which you expressly consent to and understand that payment once made to the Biller for BillPay Services is non - refundable. While we may send reminders for upcoming bill payments, failure to receive a reminder does not relieve you of your payment obligations. The Company is not responsible for any actions or inactions on your part, including any non- payment of Bills.
14. You are responsible for tracking your bills, subscription fees, recharge expiries, and due dates for any utilities, services, or recurring charges. The Company is not liable for any technical issues related to the periodic retrieval of bills from Billers/Service Providers or for any errors or discrepancies in the bills.
15. You represent and agree that the Services availed by you shall not be used to make fraudulent transactions or for unlawful and/or illegal purposes.
16. You are responsible for all transactions conducted through the Services. If you mistakenly send a payment to the wrong Biller, double pay, or send an incorrect amount (e.g., due to a typographical error), your only recourse is to contact the Biller to request a refund. The Company will not reimburse, or reverse payments that you have wrongly or erroneously made.
17. You acknowledge that if a payment has been inadvertently credited to your credit card account or bank account, we retain the right to initiate a refund through your bank automatically. By using our Services, you hereby consent to such refund being initiated either by us or by Your bank, at our request, to rectify any erroneous transaction, credit, or double payment made to your account. Upon the processing of such a transaction, we will promptly inform You of the action taken to refund the payment.
18. It is Your responsibility to ensure the full payment of the due amount every month before the due date. Failure to do so may result in additional interest or penalties for which we shall not be held liable. You are accountable for the payment of your Bills including the credit card bills before or by the due date. Failure to meet this obligation may incur extra interest on the outstanding amount.
19. You shall be responsible for any duplicate standing instructions for payment or delayed payments or any penalty/ interest levied by the Biller on the payments made.
GRIEVANCE REDRESSAL
1. Please contact us at grievance@indmoney.com for any grievance or issues that you may face from time to time.
2. If you wish to opt out of the sharing of any data, please contact us at grievance@indmoney.com.
CHARGES
By using the INDmoney Platform, you agree that there may be charges or fees associated with accessing the services and you shall be responsible for any such charges and fees that may be applicable to certain transactions or services on the INDmoney Platform. These may include, but are not limited to:
1. Third-Party Charges: Fees from third-party payment processors, Billers, or other participants involved in transactions.
2. INDmoney Charges: We reserve the right to levy Convenience fees, platform fee, data fees, or any other fees as determined by us.
Additionally, you agree to bear all applicable taxes (such as GST, duties, and cesses) related to the Services and fees.
Before completing any transaction, all charges or fees will be clearly shown. If you proceed, it will be understood as your consent to those charges. INDmoney retains the right to modify these charges at any time.
DISCLAIMER
BILLPAY SERVICES AND RELATED INFORMATION ON THE INDMONEY PLATFORM ARE DISPLAYED AND PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITH NO GUARANTEES OR WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW UNLESS STATED OTHERWISE IN WRITING. TO THE FULLEST EXTENT ALLOWED BY LAW, THE COMPANY DISCLAIMS ANY AND ALL REPRESENTATIONS OR WARRANTIES, EXPLICIT OR IMPLIED, WITH RESPECT TO THE OFFERING OR AVAILABILITY OF SERVICES INCLUDING WITHOUT LIMITATION, ANY EXPLICIT OR IMPLIED REPRESENTATION OR WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. BY USING THE SERVICES, YOU ACKNOWLEDGE AND AGREE THAT USE OF SERVICES ON THE INDMONEY PLATFORM IS AT YOUR OWN RISK. WITHOUT PREJUDICE TO THE FOREGOING, THE COMPANY OR ANY OF ITS GROUP ENTITIES AND AFFILIATES DO NOT GUARANTEE THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR WILL BE FREE OF ERRORS OR DEFICIENCIES
INDMONEY PLATFORM FUNCTIONS EXCLUSIVELY AS A FACILITATOR FOR BILL PAYMENTS AND DOES NOT PROVIDE FINANCIAL ADVICE OR ANY OTHER FINANCIAL SERVICES. WE DO NOT RETAIN ANY FUNDS OR CREDIT CARD INFORMATION ON BEHALF OF THE USER. ADDITIONALLY, WE DO NOT FUNCTION AS A TRUSTEE OR IN A FIDUCIARY CAPACITY IN RELATION TO ANY SERVICES PAYMENT TRANSACTION.
THE COMPANY AND ITS THIRD-PARTY SERVICE PROVIDERS MAKE NO WARRANTY, EXPRESS OR IMPLIED, REGARDING THE QUALITY OF THE BILLPAY SERVICES INCLUDING BUT NOT LIMITED TO THE FOLLOWING: I) THE SERVICES WILL MEET YOUR EXPECTATIONS; II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY OR ERROR FREE; OR III) ANY PRODUCTS, INFORMATION OR MATERIAL OBTAINED BY YOU IN CONNECTION WITH THE SERVICES WILL MEET YOUR REQUIREMENTS.
THE COMPANY SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY DEFECTS IN THE SERVICES PROVIDED BY BILLERS OR SERVICE PROVIDERS AND MAKES NO EXPRESS OR IMPLIED WARRANTIES REGARDING THOSE SERVICES. THE COMPANY AND ITS AFFILIATES ARE NOT LIABLE FOR ANY ACTIONS TAKEN BY BILLERS OR SERVICE PROVIDERS, OR FOR ANY LOSSES RESULTING FROM THEIR ACTIONS. FURTHERMORE, THE COMPANY WILL NOT MEDIATE OR RESOLVE DISPUTES, INCLUDING CHARGEBACKS OR REVERSALS, BETWEEN YOU AND THE BILLER, SERVICE PROVIDER, OR ANY SELLERS OR MERCHANTS INVOLVED.
THE COMPANY ACTS AS A FACILITATOR FOR WHILE PROVIDING YOU WITH A FACILITY TO RECHARGE YOUR PREPAID MOBILE, DATA, OR OTHER ACCOUNTS, BUT THE SERVICES THEMSELVES ARE PROVIDED BY YOUR PREPAID SERVICE PROVIDER, SUCH AS YOUR TELECOM PROVIDER, OR THEIR DISTRIBUTORS OR AGGREGATORS ("PREPAID SERVICE PROVIDERS"), AND NOT BY US. YOU ARE FULLY RESPONSIBLE FOR CHOOSING THE RIGHT PLAN AND ADHERING TO THE TERMS SET BY THE PREPAID SERVICE PROVIDER. THE PLANS SHOWN ON THE INDMONEY PLATFORM ARE FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT BE UP-TO-DATE. IT IS IMPORTANT THAT YOU CONFIRM THE LATEST PLAN DETAILS DIRECTLY WITH YOUR PROVIDER BEFORE PROCEEDING WITH ANY TRANSACTION.
YOU MAY CHOOSE TO ENTER A CUSTOM AMOUNT FOR BILL PAYMENTS OR RECHARGES, BUT ITS ACCEPTANCE IS ENTIRELY AT THE DISCRETION OF THE BILLER. IT IS YOUR RESPONSIBILITY TO ENSURE THE ACCURACY OF THE DETAILS YOU PROVIDE FOR PAYMENT OR RECHARGING. THE COMPANY WILL NOT BE HELD LIABLE FOR ANY FAILURE BY THE BILLER TO PROCESS THE PAYMENT OR RECHARGE, NOR FOR ANY ISSUES RELATED TO THE QUALITY OF THEIR SERVICES. ANY DISPUTES ARISING FROM SUCH MATTERS MUST BE RESOLVED DIRECTLY BETWEEN YOU AND THE BILLER. YOU ACKNOWLEDGE THAT ALL BILL PAYMENTS MADE THROUGH THE INDMONEY PLATFORM ARE FINAL AND NON-REFUNDABLE.
THE COMPANY WILL NOT BE HELD RESPONSIBLE FOR ANY DELAY OR FAILURE TO COMPLY WITH THE STATED OBLIGATIONS UNDER THESE TERMS OR TO PROCESS OR SETTLE ANY BILL PAYMENTS MADE BY YOU, IF THE DELAY OR FAILURE ARISES FROM ANY CAUSE WHICH IS BEYOND THE REASONABLE CONTROL OF THE COMPANY. CIRCUMSTANCES BEYOND OUR CONTROL MAY INCLUDE (BUT NOT LIMITED TO) NATURAL DISASTERS, BANK STRIKES, POWER FAILURE, INTERNET FAILURES, SYSTEMS FAILURES/BUGS/GLITCHES LIKE COMPUTER OR TELEPHONE LINES BREAKDOWN DUE TO AN UNFORESEEABLE CAUSE OR ANY INTERFERENCE OR DISRUPTION.
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN THE INDMONEY PLATFORM’S CONDITIONS OF USE, IN NO EVENT WILL THE COMPANY OR ITS AFFILIATES OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO BILL PAYMENTS. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
YOU ACKNOWLEDGE, UNDERSTAND AND AGREE THAT THERE MAY BE A POSSIBILITY OF COMMUNICATION FAILURE OR SYSTEM PROBLEMS OR SLOW OR DELAYED RESPONSE FROM SYSTEM OR TRANSACTION HALT/FAILURE, OR ANY SUCH OTHER PROBLEM/ GLITCH WHEREBY NOT BEING ABLE TO ESTABLISH ACCESS TO THE BBPS/BBPOU SYSTEM / NETWORK, WHICH MAY BE BEYOND COMPANY’S CONTROL AND MAY RESULT IN DELAY IN PROCESSING OR NOT PROCESSING USER’S REQUEST.
THE COMPANY IS MERELY ACTING AS A FACILITATOR FOR THE SERVICES AS PER THE INSTRUCTIONS GIVEN BY YOU. YOU AGREE AND ACKNOWLEDGE THAT THE USE OF SERVICES ON THE INDMONEY PLATFORM IS AT YOUR SOLE RISK. WITHOUT PREJUDICE TO THE FOREGOING, INDMONEY OR ITS GROUP ENTITIES DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR WILL BE FREE OF ERRORS OR DEFICIENCIES.
THE SERVICES ARE STRICTLY INTENDED FOR PERSONAL USE ONLY. YOU SHALL NOT ENGAGE IN ANY ACTIVITY, OR OTHERWISE ATTEMPT TO USE THE SERVICES OFFERED HEREUNDER FOR COMMERCIAL PURPOSES, UNLAWFUL OR UNETHICAL ACTIVITIES, INCLUDING MONEY LAUNDERING, TERRORIST FINANCING, OR ILLICIT PAYMENTS.
YOU IRREVOCABLY AGREE AND AUTHORIZE US TO UTILIZE YOUR DATA, INCLUDING BUT NOT LIMITED TO ANY DATA RELATED TO TRACKING YOUR BILLS INCLUDING CREDIT CARDS AND/OR ANY OTHER INFORMATION GENERATED UNDER THESE SERVICES FOR ANALYTICS PURPOSES, CROSS-SELLING, AND/OR FOR ANY OTHER PURPOSE CONSIDERED SUITABLE BY US TO FACILITATE YOU WITH VARIOUS SERVICES ON THE INDMONEY PLATFORM. THE COMPANY MAY UTILIZE YOUR PERSONAL INFORMATION FOR PROMOTIONAL PURPOSES WITHOUT ANY ADDITIONAL CONSENT OR COMPENSATION TO YOU.
EXCEPT AS SPECIFIED UNDER THESE TERMS, WE SHALL NOT BE RESPONSIBLE FOR ANY ASPECT OF SERVICES PAYMENT. YOU ACKNOWLEDGE THAT WE ASSUME NO RESPONSIBILITY AND SHALL INCUR NO FINANCIAL LIABILITY, IF WE ARE UNABLE TO EFFECT THE PAYMENTS TOWARDS YOUR BILL PAYMENTS INCLUDING CREDIT CARD BILL PAYMENTS IN RELATION TO OR ARISING OUT OF THE FOLLOWING CIRCUMSTANCES: (A) IF THE PAYMENT INSTRUCTION ISSUED BY YOU IS INCOMPLETE, INACCURATE, INVALID, OR DELAYED; (B) IF THE PAYMENT ACCOUNT HAS INSUFFICIENT FUNDS OR LIMITS TO COVER FOR THE AMOUNT OF THE PAYMENT INSTRUCTION OR THE BILL; (C) IF THE FUNDS AVAILABLE IN THE PAYMENT ACCOUNT ARE UNDER ANY ENCUMBRANCE OR CHARGE; AND (D) IF PAYMENT IS NOT PROCESSED BY THE THIRD- PARTY SERVICE PROVIDER OR ANY CARD ASSOCIATIONS; AND (E) FOR PAYMENT FOR AN INCORRECT CREDIT CARD ACCOUNT INPUT BY YOU / USING YOUR ACCOUNT.
YOU ACKNOWLEDGE AND ACCEPT THAT YOU BEAR ALL RISKS ASSOCIATED WITH ONLINE TRANSACTIONS. NEITHER INDMONEY NOR ANY THIRD-PARTY SERVICE PROVIDERS PROVIDE ANY WARRANTIES, EXPLICIT OR IMPLIED, REGARDING THE QUALITY OF SERVICES, INCLUDING BUT NOT LIMITED TO: (I) THE SERVICES MEETING YOUR SPECIFIC REQUIREMENTS; (II) THE SERVICES BEING UNINTERRUPTED, TIMELY, OR ERROR-FREE; OR (III) ANY PRODUCTS, INFORMATION, OR MATERIALS OBTAINED BY YOU IN CONNECTION WITH THE SERVICES MEETING YOUR REQUIREMENTS.
COMPANY SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSSES, COSTS, EXPENSES, CHARGES, INCLUDING NOTIONAL LOSSES/LOSS OF OPPORTUNITIES/LOSS OF GAIN/LOSS OF INVESTMENT OPPORTUNITY INCURRED BY A USER AS A RESULT OF ACTING OR NON-ACTING ON ANY INFORMATION/MATERIAL RECEIVED THROUGH THE SERVICE OR THROUGH ANY TECHNICAL GLITCH OCCURRED ON THE PLATFORM.
THE SERVICES ARE STRICTLY INTENDED FOR PERSONAL USE ONLY. YOU SHALL NOT ENGAGE IN ANY ACTIVITY, OR OTHERWISE ATTEMPT TO USE THE SERVICES OFFERED HEREUNDER FOR COMMERCIAL PURPOSES, UNLAWFUL OR UNETHICAL ACTIVITIES, INCLUDING MONEY LAUNDERING, TERRORIST FINANCING, OR ILLICIT PAYMENTS.
Except as specified under these Terms, the Company is not and will not be responsible for any aspect of the BillPay services. INDmoney Platform reserves the right to terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. We reserve the right to change or modify these BillPay Terms at any time without any prior written intimation or notice to you. By continuing to use the Bill Pay Services after changes are posted, you agree to the updated terms. These BillPay Terms may be modified at any time, and the updated terms will be posted on the INDmoney Platform. It is your responsibility to review the terms periodically.
